These Terms of Service govern the supply of goods and services by No More Sausages Co (“NMS”, “we”, “us”, “our”) to schools, P&C associations, not-for-profit organisations, community groups and other approved customers (“you”, “your”).

By using our website or purchasing from us, you agree to these Terms. Our Privacy Policy forms part of these Terms.

1. Supply of products

NMS supplies fundraising products, merchandise and related goods to schools, P&C associations, not-for-profit organisations and community groups. Products are supplied for fundraising, merchandise or community use unless otherwise agreed in writing.

NMS may refuse or cancel an order at its discretion, including where products are unavailable, minimum quantities are not met, payment is not received, or an error has occurred in pricing or product description.

Some products are available for direct purchase through our online store, while others are supplied under custom fundraising arrangements. Terms relating to pricing, payment, production and delivery may differ depending on the product and order type.

An order is only accepted once confirmed by NMS in writing.

2. Pricing

All prices are quoted in Australian dollars (AUD) unless stated otherwise and include GST where applicable.

Pricing may vary depending on order quantities, product mix, packaging, branding requirements and delivery arrangements. Unit pricing is based on total order volume and overall package, not individual item pricing.

Quotes are based on the information provided at the time and may change if order details change.

3. Payment

Payment terms will be agreed before production.

NMS may require a deposit before design, sourcing, planning or production allocation begins. Production will not commence until order details are confirmed, approval to print (if applicable) has been received, and any required deposit has been paid.

Unless otherwise agreed, the balance of the invoice must be paid before dispatch or within the invoice period stated. Late payment may delay production or delivery.

4. Production and delivery

NMS will make reasonable efforts to supply goods within the agreed timeframe, however delivery dates are estimates unless confirmed in writing.

Delays may occur due to supplier availability, freight delays, production issues or events outside our control. Some products are supplied or fulfilled by third‑party suppliers. NMS is not responsible for delays, disruptions or failures caused by those suppliers or carriers.

Risk in the goods passes to you once the order has been dispatched to the delivery provider.

5. Stock check and defects

You must check all goods on delivery and notify NMS of any discrepancy within five (5) business days.

Notification must include details of the issue and, where possible, photographs.

Production defects may include incorrect items or goods supplied, incorrect sizes or colours, printing errors, damaged goods or missing items.

The following are not considered defects:
change of mind, incorrect quantities ordered, minor colour variation, normal garment variation, or minor differences caused by the manufacturing or printing process.

Where a defect is confirmed, NMS may repair, replace or credit the affected items at its discretion.

6. Refunds and returns

NMS does not accept returns or provide refunds for change of mind or incorrect ordering, particularly for custom-made items or food products. 

If goods are faulty, damaged, incorrect or do not comply with the Australian Consumer Law, you are entitled to a repair, replacement or refund as applicable. 

Claims for faulty, damaged or incorrect goods must be made in accordance with clause 5 (Stock check and defects). 

Nothing in these Terms limits your rights under the Australian Consumer Law.

7. Food products 

Some products supplied by NMS are food items, including tea, chocolate and similar consumables. 

Ingredient and allergen information is provided by the supplier and made available where required. You are responsible for reviewing this information and determining whether products are suitable for your needs or your community. 

Food items cannot be returned or refunded for change of mind. If a food item is faulty or does not comply with the Australian Consumer Law, your rights will apply.

8. Changes and cancellations

Orders made to specification cannot be cancelled after production has been allocated or approval to print has been given.

Deposits are non-refundable once work has commenced.

Changes requested after approval may affect price and delivery time.

9. Use of products

Products supplied by NMS are intended for fundraising, merchandise or community use.

You are responsible for setting retail prices, running fundraising activities and complying with any rules or policies that apply to your organisation.

NMS may subcontract or outsource any part of the supply of goods or services.

NMS does not guarantee sales results or fundraising outcomes.

10. Intellectual property

All designs, artwork, branding, product concepts and materials created by NMS remain the property of NMS unless otherwise agreed in writing.

Any logos, names or artwork supplied by you remain your property, and you confirm that you have the right to use them.

You must not copy, reproduce or reuse NMS designs without permission.

11. Limitation of liability

To the extent permitted by law, NMS is not liable for any indirect or consequential loss, including loss of profit, loss of fundraising income, loss of opportunity or delay.

Our liability for any claim relating to the supply of goods is limited to the amount paid for the relevant order.

12. Australian Consumer Law

Goods supplied by NMS come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and to compensation for any reasonably foreseeable loss or damage.

Nothing in these Terms limits your rights under applicable law.

13. Events outside our control

NMS is not responsible for delay or failure caused by events outside our reasonable control, including supplier failure, freight delays, natural disasters, industrial action or government restrictions.

14. Changes to these Terms

These Terms may be updated from time to time.
The current version published on our website applies to all orders.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the jurisdiction of the courts of that State.

This Shipping and Delivery Policy explains how No More Sausages Co (“NMS”, “we”, “us”, “our”) handles dispatch, delivery and risk for orders placed through our website or directly with us.

This policy applies to all orders, including fundraising products, merchandise, wholesale items and marketplace purchases.

1. Dispatch timeframes

Dispatch timeframes vary depending on the type of order placed.

Some products are held in stock and may be dispatched within a short period. Other products, including merchandise, custom items and fundraising ranges, may require sourcing, production or packing time before dispatch.

Estimated dispatch timeframes will be provided at the time of order where possible. These timeframes are estimates only and may change due to supplier availability, production schedules or shipping delays.

Production will not commence until order details are confirmed and any required payment has been received.

2. Delivery methods

Orders are delivered using third-party courier or postal services selected by NMS.

Delivery times depend on the destination, courier service and time of dispatch. We cannot guarantee delivery on a specific date unless this has been agreed in writing.

Where delivery timeframes are provided, they are estimates only.

NMS is not responsible for delays caused by courier services, suppliers, weather events, industrial action or other events outside our control.

3. Delivery addresses

Customers are responsible for providing accurate delivery details.

If incorrect or incomplete address information is provided, NMS is not responsible for delayed or failed delivery. Additional charges may apply if an order needs to be re-shipped.

If delivery is attempted and cannot be completed, the courier may return the order or charge a re-delivery fee. Any additional costs will be the responsibility of the customer.

4. Risk and responsibility

Risk in the goods passes to the customer once the order has been dispatched to the delivery provider.

NMS is not responsible for loss, damage or delay once the order has been handed to the courier, except where required by law.

If an order arrives damaged or incomplete, the customer must notify us within a reasonable time so the issue can be investigated.

For fundraising and bulk orders, stock should be checked on arrival and any issues reported within five (5) business days.

5. Split deliveries

Some orders may be shipped in more than one delivery where items are sourced from different suppliers or produced at different times.

Where this occurs, we will make reasonable efforts to notify the customer.

Additional delivery charges will not be applied unless agreed.

6. International shipping

Unless otherwise agreed, NMS ships within Australia only.

If international delivery is requested, shipping costs, timeframes and responsibility will be agreed before dispatch.

7. Changes to this policy

We may update this Shipping and Delivery Policy from time to time to reflect changes to our business operations or legal requirements.

The current version will always be published on our website.
